ingatan saya langsung tertuju pada sebuah kliping artikel hukum saat nonton siaran langsung konser terakhir peterpan di salah satu stasiun tivi swasta, 19 oktober lalu. fyi, malam itu adalah konser tunggal terakhir ariel dkk dengan nama peterpan. mulai tahun depan mereka gak boleh pake nama peterpan lagi dan kabarnya akan eksis dengan nama band yang baru. ini konsekuensi dari sengketa di antara para personil lama peterpan [ariel dkk vs andhika dkk]. malam itu mungkin suatu konser terakhir yang tidak pernah mereka harapkan...

sengketa soal hak penggunaan nama band memang sudah sering terjadi di negeri ini. gak cuma pada band mainstream aja, band indie pun pernah mengalaminya. awalnya pas mulai nge-band memang baik-baik saja. lalu mulai sukses, trus buntutnya jadi ribut. timbul perpecahan personil yang berujung saling klaim, saling menjatuhkan. mau contoh?! selain kasus peterpan tadi, pernah ada sengketa juga pada slank [bimbim-kaka vs bongky-indra-pay], ratu, caramel, aaarrgghh, betrayer, rotten corpse, serta sederet band bermasalah lainnya... 

ya, memang tidak ada yang pernah menduga atau mengharapkan bakal ada masalah pelik di dalam internal band. sebuah artikel yang pernah saya baca berjudul 'perspektif hukum dalam terhadap pembentukan grup band' dari sebuah firma hukum mungkin bisa mengantisipasi hal-hal seperti itu. isinya konsep ideal tentang perjanjian band, pentingnya nama band, dan struktur band. artikel tersebut sudah ada di situs apokalip, di rubrik esai & opini. silahkan cek aja di sini...

q: can the band spit onstage?
a: emphatically no. spitting is an offence in singapore and is a punishable one at that. (...) if it is a situation that has become a degree habitual, then all i can say is to please exercise some constraint and if they absolutely must, exit the stage right or left, get rid of the offending problem and return to the performance.

q: can the band use swear words e.g. fuck?
a: please no. not if they can possibly help it. (...) in particular i must put the emphasis on the ever popular phrase of "mother-fucker". at all costs endeavor to avoid this. any reference to the word "mother" in this society must be with the utmost reverence. what they say and do in the privacy of their hotel rooms, dressing rooms, catering rooms, etc. is entirely their business, however when they are up there on stage and have at least 7500 adoring fans hanging on every word and the press in attendance, it would be appreciated if the more colorful adjectives were given a rest for the evening and replaced with something a little less crass...
